When determining whether cancellation is warranted, the judge considers factors including but not limited to the length of the individual\u2019s residence in the United States, their family and community ties in the United States, and community service.<\/p>\n<h3>To be eligible for cancellation of removal, a <b>permanent resident<\/b> must show that they:<\/h3>\n<ul>\n<li aria-level=\"1\">have been a lawful permanent resident for at least five years<\/li>\n<li aria-level=\"1\">have continuously resided in the United States for at least seven years and<\/li>\n<li aria-level=\"1\">have not been convicted of an aggravated felony<\/li>\n<\/ul>\n<h3>To be eligible for cancellation of removal, <b>non-permanent residents<\/b> must establish that they:<\/h3>\n<ul>\n<li aria-level=\"1\">have been physically present in the United States for a continuous period of 10 years<\/li>\n<li aria-level=\"1\">have been of good moral character during the 10-year period<\/li>\n<li aria-level=\"1\">have not been convicted of select criminal offenses and<\/li>\n<li aria-level=\"1\">that removal would result in exceptional and extremely unusual hardship to U.S. citizen or lawful permanent resident family members<\/li>\n<\/ul>\n<h2>What is the Difference Between Deportation and Removal?<\/h2>\n<p>Deportation and removal are identical actions. Removal, which includes inadmissibility and deportability, is the more current terminology for what was once referred to as deportation.
